By using the BIG Digital Download application (“App”), offered on Shopify and developed by Penida SAS ("Penida," "we," "us," or "our"), you agree to the following Terms of Service (“Terms”). These Terms govern your access to and use of the App, which is available at BIG Digital Download on Shopify, and provided by Penida SAS, a company registered in France, whose website is Penida.
This Agreement includes our Privacy Policy and any applicable Data Protection Addendums (DPA). By continuing to use the App, you agree to be bound by these Terms. If you do not agree, please uninstall the App and discontinue its use.
Services Overview
BIG Digital Download is a Shopify app that allows merchants to sell and distribute digital products through their Shopify stores. It provides various tools to manage and distribute files, license keys, and PDFs. The App offers different pricing plans, allowing flexibility depending on your store’s needs.

Fair Use Policy on Bandwidth
Fair Use Policy on Bandwidth
To ensure fair and equitable use of our services, the BIG Digital Download app enforces a Fair Use Policy on Bandwidth.
Bandwidth Limits:
Each plan includes a specific bandwidth allocation, measured on a rolling 30-day basis:
Regular: 500MB/30 days
Starter: 50GB/30 days
Pro: 500GB/30 days
Growth: 1TB/30 days
Enterprise: Custom bandwidth (agreed with Penida)
Exceeding Your Limit: If your bandwidth consumption over the last 30 days exceeds your plan's allocation, file delivery will be temporarily restricted until usage drops back within the limit. To restore access immediately, you may upgrade to a higher plan at any time.
Enterprise Overage Fees: Enterprise plan users who exceed their custom bandwidth allocation over the last 30 days will be charged $0.023 per additional GB.
Monitoring Your Bandwidth:
You can monitor your bandwidth usage at any time via your App Dashboard. Simply visit this link, and replace "NAMEOFTHESTORE" with your actual store name to access your data and bandwidth consumption. This allows you to keep track and manage your usage to avoid overage charges.
Consequences of Excessive Usage:
Exceeding the allocated bandwidth may inadvertently affect how your account is perceived on the platform. Excessive bandwidth consumption could lead to your account being reclassified from a regular digital product distributor to a high-traffic data transfer site, which falls outside the intended scope of our services.
While BIG Digital Download is optimized for digital file distribution, our infrastructure and legal framework are not designed to handle extreme levels of bandwidth use typically associated with high-traffic operations. As such, going over your limit might temporarily restrict your account’s ability to distribute new products until the bandwidth usage is brought back within the acceptable limit.
By adhering to this policy, you help ensure a smooth and fair experience for all users of the platform.
Payments and Billing
All payments are managed through the Shopify platform, and the following applies:
Billing Cycle: Payments are processed monthly according to the plan you choose.
Taxes: Fees are exclusive of any applicable taxes, including VAT or sales tax, which you are responsible for.
Overage Charges: As mentioned in the Fair Use Policy, if you exceed the bandwidth or storage limits for your plan, additional charges may apply.
You agree to keep your billing information current with Shopify. Failure to pay may result in suspension or termination of services.
Intellectual Property
Penida retains all ownership rights to the BIG Digital Download app. You are granted a limited, non-exclusive, revocable license to use the App for your Shopify store, strictly in compliance with these Terms.
You may not:
Reverse-engineer, copy, or distribute any part of the App.
Use the App to distribute content that infringes on any intellectual property right
Termination
Penida may terminate your access to the App with a two-week notice for any reason, or immediately in case of a violation of these Terms or if payment issues arise.
You may terminate the Agreement by uninstalling the App from your Shopify store. Upon termination, all data, including digital products and account settings, may be deleted permanently.
Limitation of Liability
Penida is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the App, including but not limited to lost profits, data loss, or any business interruption.
Our liability will in no case exceed the total fees paid to Penida for the 12 months preceding the claim.
Third-Party Services
Your use of the Services may rely on services and products which are offered by third parties (“Third Party Services”). We have no responsibility to you for anything third parties do (or fail to do) and we provide no warranties or guarantees about third parties or Third Party Services. Your use of Third Party Services may be subject to specific terms and conditions which are set by those third parties.
Amendments to the Terms
Penida reserves the right to amend these Terms at any time. Updates will be posted to the App or the website, and your continued use of the App signifies your acceptance of the changes. We recommend checking this page regularly for updates.
Governing Law
These Terms are governed by the laws of France. Any disputes will be resolved through binding arbitration in accordance with French law.
